What often makes Foreign Corrupt Practices Act (FCPA) compliance tricky for business organizations is that the underlying conduct can be a normal business activity. However, when gifts, corporate hospitality or other things of value are directed at a specific type of customer or prospective customer, the U.S. government might label the conduct as "bribery" and thereby expose the company to lengthy and expensive FCPA scrutiny and enforcement.
